Applies to every Icons of Pop Culture auction and website purchase
Bidder and Icons of Pop Culture agree that any agreements between the Bidder and Icons of Pop Culture, including but not limited to these Conditions of Sale, are entered into in Citrus County, Florida, which is where the agreements are to be performed and the auction to take place, no matter where Bidder is situated and no matter by what means or where Bidder was informed of the auction, and regardless of whether catalogs, materials, or other communications were received by Bidder in another location.
Both Icons of Pop Culture and the Bidder agree that any disputes under these Conditions of Sale, the subject matter hereof, the entering into, or any aspect of the auction, shall be exclusively governed by Florida law, and that any and all claims or actions shall be brought and maintained only in Citrus County, Florida, in a State or Federal Court to the exclusion of any other venue, locale or jurisdiction. All parties submit to such jurisdiction.
Our Icons of Pop Culture auctions do not use estimate pricing, only a starting minimum bid price. Opening bids do not include the buyer's premium, shipping, or sales tax.
Our Icons of Pop Culture auctions do not use reserves, so the opening price is where bidding starts, and the highest bidder will win the item.
Bidders are encouraged to send inquiries pertaining to the auction as a whole and/or an individual lot. You may also request condition reports. Icons of Pop Culture strongly urges the bidder to resolve any questions prior to bidding.
Property is auctioned in consecutive numerical order, as it appears in the catalog. Icons of Pop Culture shall determine all opening bids and bidding increments. The auctioneer will accept bids from those present in the salesroom or absentee bidders participating by telephone, Internet or by written bid left with Icons of Pop Culture in advance of the auction.
The auctioneer has the right in its absolute discretion to reject any bid in the event of a dispute between bidders or if the auctioneer has doubt as to the validity of any bid, to advance the bidding at its absolute discretion and to determine the successful bidder in the event of a dispute between bidders, to continue the bidding or to reoffer and resell the lot in question. In the event of a dispute after the sale, Icons of Pop Culture's record of final sale shall be conclusive.
Icons of Pop Culture is not and cannot be responsible or liable for any problems, delays, or any other issues or problems resulting out of use of the Internet generally or specifically, including but not limited to transmission, execution, or processing of bids. On some occasions beyond the control of Icons of Pop Culture, bid software or the Internet itself may not physically keep up with the pace of the auction. In order to help avoid disappointment, Icons of Pop Culture recommends placing a realistic absentee bid early.
The proverbial fall of the auctioneer's hammer indicates the final bid. Icons of Pop Culture will record the paddle number of the buyer. Winning bidders shall be notified with an invoice within 48 hours after the conclusion of the auction.
For each lot, Icons of Pop Culture will supply a certificate that features the item's production name and description, along with a tamper-evident, anti-counterfeit security hologram sticker and unique serial number for future reference.
If there are multiple items sold together as a lot, there will be one COA supplied to cover all items as listed in the description. COAs are not supplied with promotional items or other items not used in the production itself.
Payment is expected in full within 7 calendar days of the sale. We accept PayPal online payments, Visa, MasterCard, American Express, Discover, bank wire transfers, cashier's checks, money orders, or personal checks. PayPal allows you to pay via a bank account or credit card.
All payments made by personal check, cashier's check, and money order will require a bank funds clearance before items will be released for shipping.
Buyer pays all shipping costs. Icons of Pop Culture will ship items in-house dependent upon size or type, using either FedEx or USPS for all shipping with the exception of "special shipping required" items. For all international shipments, the buyer is responsible for all customs, duties, taxes, and fees.
Icons of Pop Culture will not ship lots that specify "special shipping required" in their description. This requires the buyer to contact a third-party shipping company to arrange for a pickup. If you are in need of third-party recommendations, we can provide you with a list.
Icons of Pop Culture does not accept returns. All sales are final. All property and lots are sold "as is" and "where is."
Any cancellation of a purchase based on a payment plan must be approved by Icons of Pop Culture, and will result in store credit only, excluding the value of the 25% non-refundable deposit — no cash refunds.
